(24-Hours To Sign This Agreement)

Time is money. We want to help you start learning how to sell your art sooner rather than later.

You agree to digitally sign a copy of this Agreement within 24 hours of enrolling.

(Let’s Do The Right Thing)

We find that most contracts contain confusing legalese. Our aim is to foster understanding, cooperation, and mutual benefit. An Agreement written in plain English helps us achieve our aim.  

We don’t want to overwhelm you with complicated language and or crowded text, so we’re intentionally using a simple format with lots of white space.

The purpose of this Agreement is straightforward. You are hiring us, "Ann Rea, Inc.", who is doing business as "Making Art Making Money®," to perform the services described below. 

This Agreement is the official record of our relationship. Our Agreement lays out what each of us can expect and must do and by when and what will happen if, heaven forbid, something goes wrong.

Please note. You already agreed to the Terms and Conditions outlined here by checking a box before your tuition payment could be processed. So that you don’t miss anything, we are reiterating the "Making Art Making Money®" Terms and Conditions below.  

However, there are certain aspects of the law that we can not translate into plain English. We’ll need to take the language up a few grade levels in these cases. We've highlighted these sections in blue. 

(100% Guaranteed Program)

If you are enrolled in the Making Art Making Money® School of Business 100% Guaranteed program you may schedule up to twelve monthly 15-minute laser accountability meetings, as needed, with one of our expert coaches.

To get the most out of your meeting, focus on a single question or concern and come prepared. 

So that we make the highest and best use of your time you agree to come prepared with any information we have requested or completed assignments.

If you are not prepared you agree that your meeting will be canceled and your meeting time will be forfeited. 

Please note. 15-minute coaching and accountability meetings are subject to limited availability and the Making Art Making Money® Code of Conduct applies during coaching calls. 

If you are late to your meeting for any reason, including any unavoidable emergencies, you agree to forfeit the time you missed.

If you miss your meeting for any reason, including any unavoidable emergencies, you agree to forfeit the time you missed.

You agree that your coaching calls will be conducted via Zoom video.

(Supported Program)

If you are enrolled in the Making Art Making Money® School of Business Supported Program you do not receive accountability meetings.

 If you are enrolled in the Making Art Making Money® School of Business Supported Program you may upgrade to the 100% Guaranteed program and receive a credit for the full amount you’ve invested in the Supported Program.

You agree that if you enroll in the "Making Art Making Money®” Special 6-Month Program then your membership, access, and all support ends six months after you enroll.  

You agree that if you enroll in the "Making Art Making Money®” Special 6-Month Program then the 100% No-Risk Guarantee does not apply.

(Self-Study Program)

If you are enrolled in the Making Art Making Money® School of Business Self-Study Program you do not receive accountability meetings or access to the community.

 If you are enrolled in the Making Art Making Money® School of Business Self-Study Program you may upgrade to the Supported or the 100% Guaranteed program and receive a credit for the amount you’ve invested.

You agree that if you enroll in the "Making Art Making Money®'' Self-Study Program then you agree that the 100% No-Risk Guarantee does not apply.

(No Lifetime Access)

You agree that "Making Art Making Money®" is providing you with access for six or 12 months after you enroll.

After six or 12 months, your license to access the "Making Art Making Money®" will be terminated, including all access to:

• online courses
• online community
• live classes
• Ann Rea
• our expert coaches

You agree that your request to renew your membership is by invitation only.

(What We Will Do For You)

"Making Art Making Money®" is a group online business education program for fine artists. 

We agree to provide you with access to "Making Art Making Money®" an online program which includes:

• self-paced online education video courses designed to help independent artists learn how to market and sell their fine art
• a private online community where you can connect with other students and ask Ann Rea questions
• live online classes if you enrolled in the 100% Guaranteed or Supported Program.

We have agreed to do a BIG job. 

So that we can do our job, you must agree to do your part as detailed in the following pages. 

(Program Tuition)

The Making Art Making Money® School of Business tuition ranges from $2,500 to $25,000 depending upon the program you enrolled in, when you were accepted, and the length of your membership.

(Graduating)

You agree that you will make every effort to graduate from "Making Art Making Money®" by completing the courses, assignments, and selling enough of your fine art to cover your tuition investment at a minimum. 

You agree that you have 6 or 12 months to graduate from the day you enroll. 

You agree that "Making Art Making Money®" can not market and sell your art, just as we cannot make your art. Graduating from "Making Art Making Money®" is up to you. 

You agree to ask for support when and if you need it.

You agree that if you enrolled in the 100% Guaranteed Program, and if for some reason, you don't earn your tuition investment back through the sale of your art within 12 months you will continue to have access to the program if:

• you show us, and we can confirm, that you have completed all the courses and assignments within six months of enrolling
• we deem your conduct professional, respectful, open, and receptive to our help
• you do exactly what we suggest to market and sell your art
• each month you post in our online community your total sales since you enrolled

You agree that your request to extend your 12 month membership in "Making Art Making Money®" may or may not be granted.

We will only continue to support you if you do the work required within the program.

(Tuition Funding)

"Making Art Making Money®" has partnered with Eaze Consulting and Klarna to provide students with tuition funding options. 

You agree that if you choose to fund your tuition through Klarna or Eaze Consulting, you are subject to Klarna or Eaze Consulting's payment terms, conditions, and interest charges. 

You agree that "Making Art Making Money®" has no control over Eaze Consulting or Klarna's interest and or terms. 

You agree that Eaze Consulting or Klarna can not refund your money.

(No Tuition Refunds)

You agree that "Making Art Making Money®" does not provide refunds for any reason whatsoever, even if: 

• you cannot attend the training
• you cannot access the internet
• you lost your job
• you have a family emergency
• there is a natural or man-made disaster
• you have technical challenges
• you have mental, emotional, psychological, or physical ailments
• you have personal challenges
• you suffer a personal tragedy 
• you don’t like the lessons
• you don’t like the assignments
• you don’t like the reading list
• you don’t like another student
• you have a religious or spiritual objection
• you're mad at us
• you just don't like Ann Rea
• you have another reason that we did not list above

You agree that "Making Art Making Money®" maintains a no refund policy in fairness to other students. You agree that enrollment into "Making Art Making Money®" is only available by application.  You agree that "Making Art Making Money®" provided you with an extensive application process designed to help you to make a careful and deliberate choice to enroll. You agree that the "Making Art Making Money®" application costs real money, resources, and time. We do not offer refunds because we can not refund time. Please note. If you elect to file a chargeback with your credit card company you understand that "Making Art Making Money®" will immediately send your account to collections which can severely damage your credit rating. If you enrolled in a traditional college or university and you decided to drop out, they also do not offer refunds.

(Program Access)

You agree that we are granting you a limited, personal, non-exclusive, non-transferable license to access "Making Art Making Money®" for six or 12 months.

You agree that your "Making Art Making Money®" license includes only you.

You agree that no one but you may access any part of "Making Art Making Money®".

You agree not to share your access, username, and password or any "Making Art Making Money®" content with anyone else, including your business partner, family, friend, or spouse. 

If you would like someone to participate in "Making Art Making Money®", then they must apply to enroll just like you did.

Please note. Self-study courses do not include any support, coaching, or participation in the private community. 

(Ann Rea's Copyright)

"Making Art Making Money®" includes any of Ann Rea’s intellectual property, including:

• videos
• .pdf downloads
• reading lists
• lessons
• exercises
• graphics
• trademarks
• trade names
• quizzes

Ann Rea's copyright is protected by US and international copyright law.  You agree not to remove any copyright notice or author designation from any part of the "Making Art Making Money®" program and materials. 

Warning: We take copyright infringement seriously. 

Copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense. We have and we will enforce Ann Rea's copyright to the fullest extent of the law.  We are not saying this to scare you. We can count on only one hand how many times we have had to enforce Ann Rea’s copyright. You should know the violators lost.  You agree to play it safe and maintain what you learn in "Making Art Making Money®" in strict confidence. 

You agree that you have no right to modify, edit, copy, sell, distribute, duplicate, lease, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of "Making Art Making Money®" in any manner or medium (including by email or other electronic means).

(Study Partners)

"Making Art Making Money®" encourages students to make friends with other students in our online community and to build their support network.

• You agree to follow our guidelines in the Study Partner lesson so that your meetings are productive and stay focused on "Making Art Making Money®".
• You agree to meet with no more than one student at a time during Study Partner meetings.  
• You agree that if you meet with someone and you don't feel like meeting with them again, you won't.
• You agree to be kind and professional to your Study Partners.
• You agree that you are not responsible for other students' success in "Making Art Making Money®".  
• You agree that you alone are responsible for your success.

(Confidentiality)

You agree that the information that you share in "Making Art Making Money®" is not confidential, including:

• comments
• discussions
• meetings
• live classes 

You agree that we cannot protect your confidentiality even though we have a "private" Facebook group.

You agree that only you can protect your privacy.

You agree to be mindful and respectful of what others share with you.

(Release)

"Making Art Making Money®" uses real students to teach and promote, including students’:

• lessons
• comments
• video interviews

You agree to permit us to use your participation in the program for promotional, educational, or other purposes, including: 

• written statements
• comments
• images
• audio recordings
• video recordings

Please note. We make no claim on the  copyright of your art. 

If you do participate in a video interview, you agree to not show your art or you waive your rights for us to show your art during the video interview.

You agree that you and your heirs waive any right to payment, royalties, and any other consideration for using such written statements, comments, images, audio recordings, and video recordings. 

You agree that you will not have the right to inspect or approve the finished product used by "Making Art Making Money®".

(Code of Conduct)

The "Making Art Making Money®" Code of Conduct is simple: you agree to abide by the "Golden Rule," which means you agree to treat others as you would like them to treat you. 

You agree that the "Golden Rule" is a subjective standard of behavior. 

You agree that to keep your conversations focused on relevant and professional topics that avoid personal views on religion, politics, and or sex. 

You agree that we will decide whether you or someone else has violated the Code of Conduct. 

"Making Art Making Money®" has, and will, expel any student without a refund if we deem it necessary to:

• maintain clear, healthy, respectful professional boundaries
• protect other students' investments
• protect your investment

You agree that if we deem that you have violated the Code of Conduct, we will, without warning, permanently:

• suspend your access to all online classes and resources 
• remove you from our online community 
• bar you from live classes 

We are not saying this to scare you. We've helped hundreds of artists over the years from 23 countries and counting. Yet we can count on only one hand how many times we have had to enforce the Code of Conduct and expel a student. 

(Non-Disparagement)

If you're struggling, you need help, or if you're not happy with "Making Art Making Money®", or even Ann Rea, you agree to tell us before you tell other people. 

You agree to give us a chance to do something to help restore your satisfaction.

We promise to do our best to help you as long as satisfying you falls within the bounds of this Agreement.

Your success is our success, so we want you to succeed.

You agree not to say anything negative about Ann Rea or "Making Art Making Money®" in any form of communication, online or offline. 

In return, we agree not to say anything negative about you in any form of 

communication, online or offline.

Warning: You agree that making false claims with consumer protection agencies and or courts is illegal. We can count on one hand the number of students who have tried this as a way to secure a refund. We're not saying this to scare you, but it didn't go well for them.

(No Solicitation)

You agree to refrain from soliciting other students for business or donations during and after participating in "Making Art Making Money®." 

If you choose to solicit other students for business or donations you will be immediately expelled without refund.

(No Advice)

You agree that "Making Art Making Money®" is not providing you with:

• medical advice
• spiritual counseling
• legal advice
• financial advice
• psychological therapy or advice

You agree not to attempt to provide other "Making Art Making Money®" students with:

• medical advice
• spiritual counseling
• legal advice
• financial advice
• psychological therapy or advice

You agree not to accept from other "Making Art Making Money®" students or coaches:

• medical advice
• spiritual counseling
• legal advice
• financial advice
• psychological therapy or advice

(Self-Care)

"Making Art Making Money®" is designed to help fine artists sell emotion, not goods or services.

Therefore, "Making Art Making Money®" will provide exercises for you to explore and express your deep emotions. 

You agree to exercise self-care while participating in "Making Art Making Money®." 

You agree that if you don't want to explore your emotions or if any activities make you uncomfortable, you agree to stop doing them.

You can still learn how to market and sell your art in "Making Art Making Money®," even if you skip exercises that involve exploring your emotions.

(Technology Requirements)

"Making Art Making Money®" is hosted on an online learning platform that we do not own, control, or maintain. 

You agree that it is your responsibility to ensure your participation by maintaining the following:

• proper hardware requirements
• proper software requirements
• reliable Wi-Fi access

You agree that it is your responsibility to remember your login id and password.

You agree that only you can change your password.

You agree that you must pay a $100 charge to change your login id which is the email address that you used to enroll in "Making Art Making Money®".

You agree that "Making Art Making Money®" is not responsible for any errors or failures caused by a breakdown or problems with your:

• Internet connection
• software
• pop-up blockers
• computer system
• email access
• spam filters
• other technical issues

(You Assume All Risks)

You agree that every endeavor in life has a risk; some risks are known, and some are unknown. 

You agree to assume all risks and/or any liability that may arise due to your participation in “Making Art Making Money®.”

You also agree that you will indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third-party claims and causes of action, including, without limitation, reasonable attorneys’ fees, arising out of any breach by you of any of the terms of this Agreement, or any use by you of the "Making Art Making Money®" program and materials. You shall provide us with such assistance, without charge, as we may request in connection with any such defense, including, without limitation, providing us with such information, documents, records, and reasonable access to you, as we deem necessary. You shall not settle any third-party claim or waive any defense without our prior written consent.

(No Warranties)

• You agree that "Making Art Making Money®" cannot and will not guarantee your success.
• You agree that you’re never going to be "discovered," and no one is coming to save you.  
• You agree that you’re different, so your results will be different. 
• You agree that you must earn your success. Achieving your success will demand your:
• scheduled study time
• focused action
• discipline
• emotional fortitude

You agree that examples of other students don’t guarantee that you’ll have the same results as they earned. You agree that "Making Art Making Money®" does not and can not control what you will learn or do. Therefore, you agree that "Making Art Making Money®" can not and does not guarantee that you will get any results using any of our: 

• ideas
• tools
• strategies
• recommendations

You agree that "Making Art Making Money®" can not be perfect. You agree that "Making Art Making Money®" can not guarantee that the information provided is:

• accurate
• complete
• reliable
• current
• error-free

You agree that "Making Art Making Money®" information and lessons are subject to change.

(Disputes and Limitation of Liability)

You agree and understand that this Agreement is governed by the laws of the United States and the State of California. 

You agree that any disputes arising from this Agreement must be handled exclusively in the County of San Francisco, California, United States courts.

If a dispute arises out of this Agreement, then the prevailing party will be entitled to recover reasonable attorneys’ fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or the prevailing party may be entitled.

YOU AGREE THAT UNDER NO CIRCUMSTANCES WILL WE BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS) ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY USE BY YOU OF THE MAKING ART MAKING MONEY® PROGRAM AND MATERIALS (WHETHER FOR BREACH OF CONTRACT, TORT, NEGLIGENCE, OR OTHER FORM OF ACTION). IN NO EVENT SHALL OUR LIABILITY EXCEED THE TUITION YOU ACTUALLY PAID TO US.

(Entire Agreement)

You agree that this Agreement forms the entire Agreement between you and "Making Art Making Money®". 

You agree that this Agreement supersedes any other Agreements and understandings between you and "Making Art Making Money®". 

I HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS AND CONDITIONS SET OUT ABOVE.
